Terms & Conditions

The contract between you and BonVivant Membership S.L. for the BV House membership.

1. Parties

These terms (the "Terms") form a binding contract between you ("Member" / "Applicant") and BonVivant Membership S.L., a Spanish private limited company with CIF B75677310 and registered office at Calle Támesis, 16, Estepona, Málaga 29688, Spain ("BV House", "we", "us").

2. The service

BV House operates a private members' club, hotel, sanctuary and digital companion app on the Costa del Sol. By submitting an application or using the website / app, you accept these Terms, our Privacy Policy and our House Rules (Code of Conduct).

3. Application & admission

  • Applicants must be 18 years or older.
  • Submitting an application does not guarantee admission. The membership committee reviews each application and reserves absolute discretion to approve or decline.
  • You must provide accurate, complete information. Material misrepresentation is grounds for revocation of membership at any time without refund.
  • A card is collected at the application stage and tokenised by Stripe. We do not charge your card unless and until your application is approved.

4. Tiers, fees & renewal

  • Each membership tier carries an annual fee and, where applicable, a one-off registration fee. The amounts in force at the time of approval will be charged on approval and are itemised on your Stripe invoice.
  • Memberships auto-renew on the anniversary date at the fee then in force. We email you the renewal amount at least 30 days before charging; if the fee has increased you may cancel before the renewal date. On renewal we charge the saved card and email a receipt.
  • You may turn auto-renewal off up to the renewal date from app settings or by writing to reception@bvhouse.co.
  • If a renewal payment fails, the membership moves to past_due. You have 14 days to update your card, after which we may suspend access until payment completes.
  • You may withdraw from the membership contract within 14 days of approval without giving any reason, by emailing reception@bvhouse.co. If the membership has already started when you withdraw, you pay only for the proportion of the membership year elapsed and receive a pro-rata refund of the remainder; the right of withdrawal is lost only once the service has been fully performed with your prior express consent and acknowledgement. Outside the withdrawal period, annual fees are non-refundable save as provided in these Terms or by mandatory Spanish consumer law.

5. Credits & in-house spend

Each tier includes an annual credit allowance shown at sign-up. Credits are valid for one membership year, do not roll over, and are non-transferable and non-refundable. Spend at the restaurant, bar, spa and hotel rooms draws against your credit balance first; any remainder is billed to your card on file via Mews.

6. Bookings, cancellations & no-shows

  • Workpods, classes and free or credit-based event RSVPs may be cancelled free of charge up to two hours before the start time.
  • Event tickets paid by card follow the terms presented for that event; where none are stated, contact us — refunds before the event are at our reasonable discretion.
  • If we cancel or materially change a paid event, you may choose a full refund of the event fee or an equivalent credit. We are not responsible for associated costs (such as travel) beyond the fee itself.
  • Repeat no-shows (three within a 30-day window) may result in temporary booking suspension, at our discretion.
  • Hotel reservations follow the cancellation terms presented at the time of booking via Mews.

7. Conduct

Members agree to abide by the House Rules. We reserve the right to revoke membership for serious or repeated breaches, including breaches of the no-photography rule, misrepresentation of guest status, or behaviour that compromises the safety or comfort of other members and staff. No refund is owed where membership is revoked for cause.

8. Guests

Members are responsible for their guests at all times. Day-pass and party-cap allowances depend on tier (see your dashboard). Guests must be accompanied by their host throughout the visit and are bound by the House Rules and by sections 10–15 of these Terms; it is the Member's responsibility to make their guests aware of them before using any facility.

9. The app, butler & AI

The in-app Butler uses AI (Anthropic Claude) to assist with bookings, orders and questions. Replies are generated, can be wrong, and should not be relied on as professional advice. For treatments, dietary needs, allergies or medical considerations, always confirm with reception. Messages you send through the Butler are processed by Anthropic to generate replies — see the Privacy Policy for detail.

10. Facilities, health & safety

  • The club's facilities — including the pool, gym, sauna, cold plunge, spa and wellness areas — are available exclusively to members and approved guests aged 18 or over.
  • Use a facility only if, to the best of your knowledge, you are in adequate physical condition to do so and are not aware of any medical condition that makes its use unsafe for you. If in doubt, consult a doctor first. We may ask you to complete a health declaration before certain activities.
  • You must follow posted safety rules, capacity limits, opening hours and the reasonable instructions of staff at all times. We may refuse or suspend access to any facility where use appears unsafe for you or for others.
  • Do not use any facility under the influence of alcohol, drugs or medication that impairs judgement, balance or circulation. Glassware is prohibited in pool and wet areas.
  • Report any accident, injury or defective equipment to staff immediately. First-aid assistance is available via reception.
  • Smoking and vaping are not permitted indoors, in line with Spanish Law 42/2010; designated outdoor areas may be provided. Hotel rooms are strictly non-smoking and a room-recovery fee applies after smoking in a room.
  • We may decline to serve alcohol to, or ask to leave the premises, anyone who appears intoxicated. This is a safety measure and applies to members and guests alike.
  • Animals are not admitted, with the exception of assistance dogs, which are welcome as provided by law.
  • Where CCTV operates on the premises for safety and security, it is signposted and processed as described in the Privacy Policy.
  • Facilities or areas may close temporarily for maintenance, refurbishment, private events, weather or seasonal operation. Short closures do not give rise to refunds; if a principal facility is unavailable for an extended period, we will offer a reasonable remedy such as a credit or a membership extension.

11. Pool, sauna, cold plunge & gym

  • Pool. The pool is unsupervised — there is no lifeguard on duty unless expressly posted. You swim at your own risk and within your own ability. Diving is not permitted, and we strongly advise against swimming alone or outside staffed hours.
  • Sauna and cold plunge. These involve deliberate exposure to extreme heat and cold. Known risks include fainting, sudden changes in blood pressure and heart rate, cold-water shock and hypothermia. Their use is not recommended for people with cardiovascular or circulatory conditions, high or low blood pressure, respiratory conditions, epilepsy, during pregnancy, or while taking medication affecting heart rate or circulation — obtain medical advice before use. Keep sessions short, hydrate, exit immediately if you feel unwell, and avoid using these facilities alone when the area is unstaffed.
  • Gym. Use equipment only as intended and within your capability; ask staff for an induction if you are unsure of any machine. Stop exercising if you experience pain, dizziness or shortness of breath. Do not use equipment reported or marked as defective. External personal trainers require prior authorisation and act under their own professional responsibility.

12. Spa & treatments

  • Before any treatment you must disclose relevant medical conditions, allergies, injuries, pregnancy and medication. Practitioners may decline or adapt a treatment where it appears contraindicated.
  • Treatments are wellness and relaxation services, not medical care, and are no substitute for professional medical advice, diagnosis or treatment.

13. Assumption of risk

Use of the pool, gym, sauna, cold plunge, spa and other sports or wellness facilities carries inherent risks — including physical injury and the aggravation of pre-existing conditions — that cannot be entirely eliminated even with proper care. By choosing to use these facilities you voluntarily accept those inherent risks; the health and safety guidance in sections 10–12 exists to help you manage them. We may additionally require a signed health declaration or acknowledgment of inherent risk for specific activities, classes or events. Membership fees do not include personal-accident insurance; you are responsible for any personal cover you wish to hold. This section reflects your own responsibility for using the facilities sensibly; it does not exclude or limit any liability of ours that cannot be excluded under Spanish law (see section 15).

14. Personal property & vehicles

  • Personal belongings are brought into club areas at your own risk, except where loss or damage is caused by our negligence. Lockers, where provided, are a courtesy and do not create a deposit or custody obligation on our part.
  • For hotel stays, the statutory liability of hotel keepers under Articles 1783 and 1784 of the Spanish Civil Code applies as provided by law. Please declare valuables at reception and use the in-room safe.
  • Vehicles are parked at the owner's risk; we accept no custody of vehicles or their contents unless a supervised parking service is expressly contracted.
  • Items found on the premises are held for 90 days and may thereafter be donated or disposed of.
  • Members are liable for damage to club property caused by them or their guests beyond ordinary wear and tear.

15. Liability

To the fullest extent permitted by Spanish law, BV House's liability is limited to the amount you have paid in fees in the twelve months preceding the event giving rise to the claim. This cap and the exclusions in these Terms do not apply to — and nothing in these Terms excludes or limits — liability for death or personal injury, or for other loss or damage caused by our negligence or our breach of these Terms, for fraud or wilful misconduct, or any other liability that cannot be excluded or limited under mandatory Spanish law, including consumer law. We are not responsible for failures or delays caused by events beyond our reasonable control (force majeure), nor for services you contract directly with independent third parties (such as external personal trainers, excursion or transport providers), which remain the responsibility of their providers.

16. Termination

You may terminate your membership at any time from app settings or by writing to reception@bvhouse.co; access continues until the end of the current membership year. We may terminate for material breach (including under §7) with notice or immediately for serious cause. Upon termination, your data is retained per the Privacy Policy.

17. Governing law & disputes

These Terms are governed by the laws of Spain. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Courts of Málaga, save where Spanish consumer law grants you the right to bring proceedings in your place of residence.

18. Changes

We may update these Terms from time to time. Material changes are notified to active members by email or in-app notice with at least 30 days' notice; continued use after the effective date constitutes acceptance. The current version is dated 2026-05-01.
